Terms and Conditions

These terms apply to filming, photography, editing, live streaming, production and related services supplied by MJ Films.
In these terms, “we”, “us” and “our” mean MJ Films. “Client”, “you” and “your” mean the person, business or organisation commissioning the work.
1. Quotations and bookings
Our quotation will describe the agreed services, production time, deliverables, price and any additional costs.
Unless stated otherwise, quotations remain valid for 30 days.
A booking is confirmed when:
- you accept our quotation or booking confirmation in writing; and
- we receive any booking payment requested.
Dates remain available to other clients until the booking has been confirmed.
Your quotation, agreed production brief, relevant written correspondence and these terms together form the agreement between us. If there is a conflict, a specifically agreed written term will take priority over these general terms.
2. Prices and payment
Prices are based on the information supplied when the quotation is prepared.
Payment dates will be shown on the quotation or invoice. Unless another arrangement has been agreed, all outstanding charges must be paid by the stated due date.
Additional filming time, editing, travel, crew, equipment, accommodation, licences, location fees or other work outside the agreed scope may be charged separately.
We will explain any significant additional charge before carrying out the work wherever reasonably possible.
Business clients may be charged statutory interest and debt recovery costs on overdue commercial invoices where permitted by law.
We may pause editing, withhold delivery or decline further work while an invoice remains overdue.
3. Booking payments
Any booking payment will be shown clearly on the quotation or invoice.
A booking payment reserves production time and may also cover planning, administration, travel arrangements, crew commitments and other preparatory work.
If you cancel, we may retain or charge an amount reasonably required to cover:
- work already completed;
- costs we cannot recover;
- crew, travel, venue or supplier commitments;
- production time that we are unable to rebook; and
- other direct losses caused by the cancellation.
We will take reasonable steps to reduce our losses and will not charge more than the loss reasonably caused by the cancellation.
4. Consumer cancellation rights
This section applies where you are an individual booking services mainly for personal purposes rather than for business purposes.
Where the booking is made online, by telephone or by email, you may have a legal right to cancel within 14 days of the contract being formed.
You may ask us to begin planning, filming, editing or other work during that period. Where you do so, you agree to pay a reasonable amount for work completed and costs incurred before cancellation.
Your cancellation right may end once the service has been fully completed, provided you expressly asked us to begin during the cancellation period and acknowledged that the right would end following full performance.
These terms do not reduce any rights you have under consumer law.
5. Cancellations and postponements
You must tell us as soon as possible if you need to cancel or postpone a booking.
Where a booking is postponed, we will try to transfer the booking to another available date. We cannot guarantee that the original crew, equipment or price will remain available.
Additional travel, accommodation, crew, venue, equipment or supplier costs caused by postponement will be payable by the client.
If we secure replacement work for the original date, we will take that into account when calculating any cancellation charge.
A change of location, filming date, production length or project scope may be treated as a postponement or new booking where it materially changes the work required.
6. Our cancellation or inability to attend
If we cannot carry out the work because of illness, injury, equipment loss or another serious problem, we may:
- provide a suitably experienced replacement;
- agree a new production date; or
- refund the part of the fee relating to services that cannot be supplied.
We will contact you as soon as reasonably possible and take practical steps to reduce disruption.
7. Client responsibilities
You must provide accurate information about the project, including:
- filming locations;
- production dates and times;
- access arrangements;
- parking and loading restrictions;
- the intended audience and use of the finished material;
- required formats and deadlines;
- known safety or security requirements; and
- any confidentiality restrictions.
You are responsible for obtaining permission to film at locations arranged by you unless our quotation says otherwise.
You are also responsible for ensuring that contributors, employees, performers, guests and members of the public under your control have been properly informed about the filming where required.
You must tell us before production about vulnerable contributors, children, medical environments, secure locations or other circumstances requiring additional consent or safeguarding measures.
8. Materials supplied by the client
You confirm that you have permission to provide and use any logos, music, photographs, footage, scripts, graphics, presentations, trademarks or other materials supplied to us.
We are not responsible for copyright, trademark, privacy or licensing claims arising from material supplied or specifically requested by the client.
You agree to reimburse us for reasonable costs or claims caused by your unauthorised supply or use of third-party material.
9. Production schedule and access
Filming time begins at the agreed start time or when our crew arrives at the location, depending on the terms of the quotation.
Delays caused by the client, venue, contributors, access restrictions, incomplete preparation or changes to the schedule may reduce the amount that can be filmed within the booked period.
Additional time may be charged at the rate shown in the quotation.
We may stop or suspend work where conditions are unsafe, unlawful, abusive or likely to damage people, property or equipment.
10. Creative and editorial decisions
Unless the brief specifies otherwise, we will make reasonable creative and technical decisions regarding:
- camera positions;
- lighting;
- sound recording;
- interview framing;
- shot selection;
- editing;
- music;
- pacing;
- colour treatment; and
- the structure of the finished video.
References, example films and mood boards indicate the intended direction but do not guarantee an exact copy of another production.
Our obligation is to provide the agreed service with reasonable care and skill. We cannot guarantee a particular number of views, enquiries, sales, bookings, awards, publicity results or audience response.
11. Editing and revisions
The number of edits, versions and revision rounds included will be stated in the quotation.
Feedback should be:
- clear;
- consolidated into one response;
- supplied by the agreed decision-maker; and
- returned within the requested timescale.
Conflicting or staged feedback from several people may result in additional editing charges.
Changes that alter the agreed brief, script, structure, duration or purpose of the film may be treated as additional work.
Once a final version has been approved, further amendments may be charged separately.
We are not responsible for errors in names, titles, dates, figures, claims or wording supplied or approved by the client.
12. Delivery
Delivery dates are estimates unless a fixed deadline has been expressly agreed in writing.
Delivery may be delayed by:
- late client feedback;
- changes to the brief;
- unavailable contributors;
- delayed approval;
- third-party licensing;
- technical problems;
- illness;
- supplier delays; or
- circumstances outside our reasonable control.
Finished material will normally be supplied by download, private link, cloud transfer or another agreed method.
The client is responsible for downloading and safely backing up delivered files.
13. Raw footage and project files
Raw footage, audio recordings, camera originals, edit timelines, project files, graphics templates and unused material are not included unless expressly stated in the quotation.
Where raw footage is supplied, it may require professional software, storage and technical knowledge to use.
We do not guarantee indefinite storage of footage or project files. Unless otherwise agreed, files may be deleted 90 days after final delivery.
Retrieving, restoring, transferring or re-editing archived material may carry an additional charge.
14. Copyright and usage rights
Unless copyright is expressly transferred in a signed written agreement, MJ Films retains copyright in footage, photographs, edits, graphics and other material created by us.
Once all invoices have been paid, you receive a licence to use the approved finished work for the purposes described in the quotation.
Unless otherwise stated, this licence allows the client to publish the finished material on its own:
- website;
- social media accounts;
- internal systems;
- presentations;
- advertising channels; and
- marketing materials.
The licence does not automatically include:
- resale to another business;
- transfer of ownership;
- stock-library distribution;
- use by unrelated third parties;
- use of rejected edits;
- use of raw footage;
- removal of third-party licence restrictions; or
- uses outside the agreed project.
A wider licence or full copyright transfer can be quoted separately.
All usage rights are conditional upon full payment.
15. Music, stock material and third-party licences
Music, stock footage, photographs, fonts, graphics and other licensed assets may be governed by third-party licence conditions.
The licence may apply only to the agreed client, project, platforms, countries or advertising campaign.
We are not responsible for uses outside the licence purchased for the project.
The client must not extract, resell or reuse licensed assets separately from the finished production unless the relevant licence permits it.
16. Showreels and portfolio use
For commercial projects, unless otherwise agreed in writing before production, you permit us to display reasonable extracts, still frames and project information on our website, social media, showreel, proposals and portfolio.
We will respect agreed publication dates, embargoes, non-disclosure agreements and confidential information.
Footage commissioned for private or domestic purposes, including weddings and funerals, will not be published or used for promotion without permission.
17. Drone filming
Drone filming is subject to:
- weather conditions;
- airspace restrictions;
- aviation rules;
- site access;
- landowner permission;
- public safety;
- nearby people and buildings;
- local restrictions; and
- the pilot’s final safety assessment.
A drone shot listed in a quotation is not guaranteed where it cannot be carried out safely or legally.
Where practical, we may substitute ground-based footage. Cancellation of the drone element alone does not automatically cancel the remainder of the production.
Applications, permissions or specialist drone arrangements outside the original quotation may carry an additional charge.
18. Live streaming
Live streaming depends on mobile networks, venue internet, power supplies, streaming platforms and other third-party systems.
We will use reasonable professional measures to provide a stable transmission, but cannot guarantee an uninterrupted stream where a failure is caused by matters outside our reasonable control.
Where included in the quotation, we may create a local backup recording. A backup recording does not guarantee that every moment will be captured in the event of equipment, media or power failure.
The client is responsible for supplying accurate event timings, venue permission and any private link or access requirements.
19. Confidentiality
We will take reasonable care with confidential information supplied for the project.
Any specific confidentiality, security, data-handling or non-disclosure requirement must be agreed in writing before production.
We may use trusted crew members, editors and suppliers where required to complete the work. They will receive only the information reasonably needed to carry out their role.
20. Personal information
We use personal information to respond to enquiries, prepare quotations, manage bookings, carry out productions, deliver work, maintain business records and receive payment.

The client must not ask us to collect, film, store or publish personal information unlawfully.
21. Equipment and technical failure
We maintain professional equipment and take reasonable precautions, including the use of backup equipment where appropriate.
Filming and live production cannot be made entirely free from technical risk.
If footage is lost or unusable because of an equipment or media failure for which we are responsible, our remedy may include:
- a reasonable re-shoot where possible;
- further editing;
- replacement work; or
- a refund or price reduction relating to the affected service.
The appropriate remedy will depend on the circumstances and whether the event can be recreated.
22. Events outside our control
Neither party will be responsible for delay or failure caused by circumstances outside its reasonable control.
These may include severe weather, flooding, fire, illness, transport disruption, road closure, power failure, internet failure, venue closure, industrial action, government restrictions, civil emergency or the failure of a third-party platform or supplier.
We will try to rearrange the work where reasonably possible. Work already completed and unavoidable costs will remain payable.
23. Liability
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation; or
- rights that cannot legally be excluded.
For business clients, we will not be liable for indirect or consequential loss, loss of profit, loss of opportunity, loss of anticipated savings or damage arising from uses outside the agreed brief.
For business clients, our total liability relating to a project will normally be limited to the total fees paid or payable for that project, except where such a limit would be unlawful.
Consumers retain all rights and remedies provided by law.
24. Complaints
Please tell us promptly if you believe there is a problem with our work.
Where possible, include:
- the project name;
- the relevant file or video;
- the timecode or section concerned;
- a clear description of the problem; and
- the outcome you are seeking.
We will review the issue and respond within a reasonable period.
We should be given a reasonable opportunity to correct a genuine production or editing error before you appoint another supplier or incur replacement costs.
25. Website content
The information on this website is provided for general guidance.
Prices, equipment, crew availability, locations and services may change. A website page does not constitute a confirmed quotation or booking.
You may not copy, republish or commercially use our website text, photographs, videos, branding or design without permission.
Links to third-party websites are provided for convenience. We are not responsible for their content, availability or privacy practices.
26. Changes to these terms
We may update these terms occasionally.
The version applying to your project will normally be the version provided or available when the booking is confirmed, unless a later change is agreed in writing.
27. Governing law
These terms and any dispute arising from them are governed by the law of England and Wales.
The courts of England and Wales will have jurisdiction, subject to any mandatory rights available to consumers living elsewhere in the United Kingdom.
